This Court may modify, reverse, remand for rehearing or set aside the decision of the Missouri Division of Employment Security ("the Commission") when there is insufficient competent evidence in the record to warrant the decision. Section 288.210. Whether an employees actions constitute misconduct associated with the employees work is a question of law. Dixon v. Division of Employment Security, 106 S.W.3d 536, 540 (Mo. App. W.D. 2003). We, however, must accept the Commissions judgment on the evidence and defer to the Commission on determinations regarding weight of the evidence and the credibility of witnesses. Id.
